Official Contest Rules and Regulations
NO PURCHASE NECESSARY TO ENTER OR WIN. SUBJECT TO ALL FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. VOID WHERE PROHIBITED BY LAW. By entering the National Career Video Contest (the "Contest") entrants agree to be bound by these Official Contest Rules and Regulations ("Rules"). The Contest commences at 12:00 a.m. Eastern Time ("ET") on November 1, 2009 and ends at 11:59:59 p.m. ET on January 31, 2010 (the "Contest Period").
Sponsor: The Contest is sponsored by C&F Ventures, LLC ("Sponsor"), PO Box 83637, Gaithersburg, MD 20878.
Eligibility: The Contest is offered and open only to legal residents of the fifty United States and the District of Columbia who have a valid E-mail address. The Contest is not open to: (1) employees, independent contractors, officers, and/or representatives Sponsor, Sponsor's parent, related, affiliated and/or subsidiary companies, Sponsor's advertising, promotion and fulfillment agencies or Sponsor's legal advisors, or (2) the immediate family members of, and persons living in the same household as, any of the foregoing persons.
How to Enter: Visit http://www.careervideocontest.com during the Contest Period and submit an Official Entry including your name, address including zip code, telephone number, your primary e-mail address and answers to other questions on the Official Entry form, and upload a video application not to exceed 50 fifty (50) minutes in total length /200 MB in .MOV, or .MPG file format (collectively "Online Entry"). Online Entry must consist of separate video clips responding to 15 individual questions for which the entrant provides responses to each. Content of Online Entry video clips, limited to not more than three (3) minutes in length per question, shall consist of original video and audio commentary describing the response to the individual question. Music may be included in any Online Entry submitted provided it is original material and not subject to copyright protection. Any Online Entry submitted must include an acknowledgement of release (“release”) whereby entrant stipulates that all individuals, featured and in background, have agreed to have their likeness and their comments entered in the contest by signing a release for the entrant. The presence of children in the video clip is allowed, but only if entrant stipulates that the parent or legal guardian of such children has signed the release. No previously published video clips may be submitted nor will such a submission qualify as an Online Entry.
Transfer of Ownership: All Online Entries become the sole property of the Sponsor and will not be acknowledged or returned. No correspondence will be entered into, acknowledged or returned. Sponsor reserves the right to edit, publish, broadcast or otherwise use any Online Entry without further permission, consideration or payment to the entrant. By submitting an Online Entry, entrant warrants and represents that Online Entry is 100% original creation/work by entrant and that use of the Online Entry as described herein will not violate any law or infringe upon the rights of any third party. All Online Entries must be received by 11:59:59 PM ET on January 31, 2010. Duplicate Online Entries received will be allowed, provided the entries are for different subjects. In the event the same video clip is submitted by more than one entrant, the first Online Entry received will be accepted and all additional duplicate Online Entries will be deemed void.
Use of automated devices is not valid for entry. Online Entries must include a valid e-mail address for the entrant. Sponsor and the respective parent, related, affiliated and subsidiary companies, advertising, promotion and fulfillment agencies and legal advisors and their respective officers, directors, agents, employees, and assigns (collectively, the "Released Parties") are not responsible for any problems or technical, hardware, or software malfunctions of any telephone network or telephone lines, failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Contest, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsor due to technical problems, human error or traffic congestion, unavailable network connections on the Internet or at any website, or any combination thereof, including, without limitation, any injury or damage to entrant's or any other person's computer relating to or resulting from participating in this Contest or downloading any materials in this Contest.
Privacy Policy: If an Entrant elects to receive future communications from contest sponsors and/or any of their affiliated companies by placing or failing to remove a mark within the associated box on the Official Entry form, such entrant's information will be shared with these sponsors and their affiliated companies. All entrant’s information collected during this Contest will become sole property of Sponsor, and may be shared with Sponsor’s parent, related, affiliated, and/or subsidiary companies, as well as Sponsor’s advertising, promotion and fulfillment companies, unless specifically requested by Entrant to remove entrant’s information from such collected information.
By submitting an Online Entry, Entrant agrees to abide by the terms of these Rules, the terms of the National Career Video Contest Terms and Conditions, and the National Career Video Contest Privacy Policy.
“Winning Entries” Judging Criteria: Online Entries that include profanity, inappropriate or explicit language or demonstrate any lewd or sexually suggestive gestures or full or partial nudity will be disqualified. Online Entries that use copyrighted or otherwise protected images, brands, and/or music may result in disqualification. A total of three (3) "Winning Entries" will be selected from among all Online Entries received. The Winning Entries will be selected based on the following judging criteria: Informative Value; Technical Presentation; and Creative Value. The judging of Online Entries will be conducted by a panel of judges selected by the Sponsor, whose decisions are final and binding in all respects relating to the selection of all "Winning Entries". In the event of a tie, the tied Online Entries will be re-judged by a single member of the panel selected by Sponsor who will serve as the tie-breaker using the same criteria as outlined herein.
All "Winning Entries" will be notified by e-mail, and overnight mail on or about March 15, 2010. If a "Winning Entries" Finalist's notification is returned as undeliverable, such "Winning Entries" will be disqualified. The "Winning Entries" will need to complete a prize claim form (that includes, among other things, being otherwise eligible to receive the prize being awarded, and agreement to participate in a video interview with a representative of Sponsor to be included in the National Career Video Contest website and related websites of Sponsor. Such Prize Claim Form to be completed and returned to Sponsor by March 31, 2010. All “Winning Entries” entrants will be required to sign and return an Affidavit of Eligibility, Liability and Publicity Release. Non-compliance will result in disqualification of such "Winning Entries" and the next highest scoring entrant may become a "Winning Entries” selection. In the event an insufficient number of qualified Online Entries is received (as determined by the judges), this Contest may be cancelled.
Featured Winning Entries: All of the "Winning Entries" selected may be featured at http://www.careervideocontest.com between 12:00 a.m. ET on April 1, 2010 and 11:59:59 PM ET on July 31, 2010 (the "Winning Entries Featured Period").
A Finalist Prize Winner may decline and thereby waive his/her right to receive a Finalist Prize. In order to claim a Finalist Prize, Finalist Prize Winners must be willing to complete a video interview with Sponsor, or Sponsor’s designated agent, and will be required to complete an Affidavit or Declaration of Eligibility and/or a Release and Waiver and Authorization To Reproduce Likeness (collectively, the "Documentation"). The Documentation must be returned within ten (10) business days of receipt of notification containing such Documentation. A potential Finalist Prize Winner's failure to sign and return the Documentation within ten (10) business days, or to comply with any other term or condition of these Rules may, at the sole discretion of Sponsor, result in disqualification, forfeiture of his or her Finalist Prize, and the next highest scoring "Winning Entry" will become a Finalist Prize Winner. Except where prohibited by law, a Finalist Prize Winner's acceptance of a Finalist Prize constitutes permission to use his/her name, voice/testimonial, hometown, Online Entry and/or likeness/photograph for promotional, advertising and/or publicity purposes in any media, now or hereafter known throughout the world in perpetuity, without further notice or compensation.
Finalist Prizes and their Approximate Retail Values ("ARV"): Three (3) Finalist Prizes: First Prize is a new Apple Macbook Pro notebook computer. Second Prize is video lighting kit. Third Prize is a gift card to be redeemed at an electronics retail chain (to be determined prior to awarding of prizes) valued at $500. Each Finalist Prize will be awarded to only one entrant in this contest. Actual retail value of each Finalist Prize may vary based upon pricing fluctuations and marketing discounts in the future. Any difference between stated ARV and actual retail value of Finalist Prizes will not be awarded. Sponsors shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, or other irregularity that may be caused by the awarding of these Finalist Prizes. No substitution, refund, cash redemption, assignment or transfer of Finalist Prize permitted. Sponsor reserves the right to substitute a prize of equal or greater value in the event that the Finalist Prize is unavailable. Finalist Prize Winners are solely responsible for all federal, state and local taxes on Finalist Prize.
Participation: Participation in the Contest constitutes an agreement by each entrant to comply with these Rules. These Rules will be posted at http://www.careervideocontest.com between November 1, 2009 and December 31, 2010. Sponsor reserves the right to, in its sole discretion, cancel, modify or suspend the Contest should any computer virus, bugs or other technical difficulty or other causes beyond the control of the Sponsor or Released Parties corrupt the administration, security or proper execution of the Contest.
Limitations of Liability: By entering the Contest, you agree that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prize awarded, shall be resolved individually without resort to any form of class action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney's fees; and (3) under no circumstances will you be permitted to obtain any award for, and you hereby waive all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
Construction: All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of any entrant vis-à-vis Sponsor, shall be governed by, and construed in accordance with the laws of the State of Maryland, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Maryland, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Maryland. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision was not contained herein.
General Release: By entering the Contest, you release and discharge Sponsor and Released Parties from any liability whatsoever in connection with the Contest or with the acceptance, possession, use or misuse of any prize including, without limitation, legal claims, costs, injuries, losses or damages, demands or actions of any kind (including, without limitation: personal injuries; death; damage to, loss or destruction of property; rights of publicity or privacy; and defamation or portrayal in a false light). Sponsor and Released Parties will not be responsible for typographical, printing or other inadvertent errors in these Rules or in other materials relating to www.careervideocontest.com and the National Career Video Contest.
